2. Scope

These HP Create Terms and Conditions (the "Terms") govern any order placed via the HP Create website and the registration and use of an HP Create Account. Therefore, before placing an order or registering for an HP Create Account, you should carefully read the terms and conditions set out below. If you wish to purchase any product (as defined below), you must click to acknowledge and affirmatively accept the Terms on the website. If you do not accept these Terms, then please do not create an account or order any products from this website.


Some sections of these Terms apply only to Consumer Customers. A Consumer Customer is an individual who purchases products or services for non-business use (i.e., for use wholly or mainly outside of their trade, business, craft or profession and not for commercial gain).


In addition to these Terms, your use of our website is governed by our Terms of Use, which are incorporated by reference into these Terms.


Under these Terms, the term “User Submission” means your photos, images and other data you submit to our website as described in our Terms of Use.

3. HP Create Account

In order to create an account with the HP Create website, you must be at least 18 years of age. If you are not, please do not set up an account with HP Create.


We allow you to upload and store your User Submissions to your account and to use them to create products. HP Create must not be used as your main or back-up storage facility for this data. You must make sure that your data is securely stored elsewhere, because we do not guarantee that we will continue to make storage available to you.


You may login and delete your User Submissions from your account at any time. We have retention periods for data in your account, which may change from time to time. After these periods have expired, your data will be deleted. We are obliged by law not to retain personal data (such as your User Submissions) for longer than we reasonably need it for our business purposes.


We will not be responsible for the loss of, deletion or corruption of User Submissions however caused (including if the loss or corruption is caused by human error, software or hardware failure, failures of telecommunications or internet services, or events beyond our control).


You must ensure that the email address on your HP Create Account is valid and accessible by you, as we will be sending you important messages there. If you change email address, then you must change it on your account.


If you are found to be in breach of these Terms, we reserve the right to suspend your HP Create Account, your order and all access to HP Create's website or applications. In addition, we are entitled to suspend provision of all or part of our services at any time if we are obliged or advised to comply with an order, instruction or request of any limb of government, or any regulator, court or other competent authority.

4. Prices, Taxes and Delivery Charges

Prices, delivery charges and payment terms shall be as specified on the HP Create website at the time you place your order. HP Create at its sole discretion, may operate time-limited discounts.


Where applicable, HP Create’s prices include taxes, duties, levies or similar charges, such as any applicable value added taxes (“VAT”).


Prior to submitting your order, you will have the opportunity to review product prices and any applicable value added taxes and delivery charges. Please notify HP Create promptly should you believe your order has a pricing error. We are under no obligation to provide any product to you at the incorrect (lower) price if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing.


HP Create reserves the right to change information, products and / or prices published on the HP Create website at any time, but changes will not affect any order in respect of which we have already sent you an order confirmation.

5. Invoicing and Payment Methods

Invoices can be sent by email in PDF format to the email address provided on the order.

The payment methods accepted by HP Create are: Credit cards and Debit cards processed through Visa, Mastercard, American Express, Diners Club, Apple Pay and Google Pay.

6. Orders

You must be at least 18 years old to place an order on the HP Create website.


Once your order is placed, it cannot be edited or cancelled without cause. It is up to you to ensure the content you have contributed for inclusion in a product is correct (for example, correctly spelt). Please double-check your order on screen carefully to check that all the details are correct before you complete your order.


HP Create reserves the right to review your order. In case of any irregularities or inconsistencies in your order or failure to pass our payment and anti-fraud checks, HP Create can reject your order. Your order will be processed by HP Create as soon as it has been validated by HP Create.


HP Create will send you an order confirmation or rejection notice as soon as reasonably possible.


The contract of sale between you and HP Create will only be formed when we send you the order confirmation.


If and to the extent possible under applicable law, we may use personal information provided in order to conduct appropriate payment and anti-fraud checks. Personal information that you provide may be checked against a credit reference or fraud prevention agency, which may keep a record of that information.

7. If we cannot fulfil your order

Despite our best efforts, on rare occasion, we may be unable to fulfil your order for a product (whether or not payment was made), because of something we discover after we send you an order confirmation email. If this is the case, we will, as soon as reasonably possible and no later than the planned delivery date, either contact you for instructions or reject your order and notify you of such cancellation. We may be unable to fulfil your order because:


  • we have identified an obvious and unmistakable error in the price or description of the product;
  • your User Submission is corrupted, unsupported technically or inadequately pixelated;
  • your order or User Submission contravenes, or appears to contravene, our Terms of Use;
  • your delivery address is outside our stated delivery areas, for details see: Section 8 below “Delivery”;
  • unexpected limits on our resources which we could not reasonably plan for;
  • your transaction is declined by your bank, you fail to pay in accordance with the terms of your selected payment method, or we reasonably suspect that the order has been placed fraudulently; or
  • the product is out of stock due to material supply constraints we did not have reasonable opportunity to notify you of in advance.

If payment was made and your order is cancelled by HP Create, HP Create will issue a full refund within 14 days via the same method you used to pay (or may contact you to collect information in order to do so).

8. Delivery

Our website contains information on estimated delivery times for each of our products (typically 6-8 working days for standard delivery) and these may differ depending on the delivery method you select, whether additional checks and verifications by HP Create are required and time of year, as holiday seasons or other circumstances may affect the time required to process orders in our production facilities.


We deliver only to UK residential addresses. Our deliveries typically take place on working days, being Mondays to Fridays only (excluding bank holidays). Saturday deliveries are also available in some locations.


If our supply of the products is delayed by an event outside our reasonable control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract by phoning us at +442076600028 and receive a full refund for any products you have paid for but not received.

9. Ownership and Risk Transfer

Ownership of product(s) passes to you upon the later of full payment and delivery of the product. Risk of loss and damage passes to you upon delivery.

10. Intellectual Property Rights (“IPR”)

No transfer of ownership of any intellectual property will occur under these Terms. HP Create respects the intellectual property rights of everyone. HP Create reserves the right to cancel orders that could be infringing content.


Please note that, while you retain ownership of your User Submission, any template or layout in which you arrange or organize such User Submission through tools and features made available through HP Create or any other of our Sites and Apps are not proprietary to you, and the rights to such template or layout will remain with us.

11. No statutory withdrawal right

The products available for purchase on the HP Create website all require personalisation and will be made to your specification. Accordingly, the statutory withdrawal right for Consumer Customers to change their minds within 14 days of delivery does not apply to orders placed on the HP Create website.


Customers of HP Create have no right of return without cause. See Section 12 (Defects on Delivery) for your rights if you receive a product that is faulty or was misdescribed.

12. Defects on Delivery (30-day right to reject)

We encourage you to check your product(s) at the earliest opportunity for any defects or discrepancies (e.g. shipping box appears damaged, wrong product delivered, product is cosmetically damaged (scrapes, tears, dents, etc.)).


If the product(s) have been delivered in a defective condition, please notify HP Create at +442076600028, as soon as reasonably possible but, in any case, more than 30 days after delivery to exercise your 30-day right to reject. HP Create may request photographic or other evidence of the defect.


If you reject any products under this Section 12, you will receive a full refund of the amount you paid, unless you and HP Create agree an alternative remedy (for example, replacement product). We will provide the refund using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise.


You must take reasonable care of all products whilst they are still in your possession. We may reduce the refund due to you to reflect any loss in value of the product(s), or require you to pay the relevant sum to us, if the loss is the result of damage caused by you.


Customers purchasing for business use have no right of return outside this 30-day right to reject period.


The 30-day right to reject applies in addition to and not in substitution for Consumer Customer’s statutory rights relating to faulty or misdescribed goods or services, the benefit of which are subject to specific conditions (see Section 13 below).

13. Consumer Legal Guarantee

Consumer Customers have statutory rights if the product(s) purchased does not conform with the contract of sale.


If a fault appears within the first 6 months after delivery, HP Create will at your request on notification, repair or replace the defective product(s) or, where such remedy is disproportionate or impossible, offer a refund or price reduction. From 6 months after delivery, you need to prove to HP Create that the defect was present at the time of delivery in order to invoke such rights.

14. Guarantee Limitations and Exclusions

Your User Submissions are uploaded to HP Create on the basis that HP Create will not review or edit any of the content or any other information contained in or relating to your order, or otherwise exercise any control or judgment of your User Submissions. Accordingly:


  1. your order is provided to you with your User Submissions "as submitted". We cannot accept responsibility if your product does not meet your expectations due to defects in the User Submission provided to HP Create;
    1. Quality Standards for Images: To ensure the highest quality of our products, we recommend that all submitted images have a resolution of at least 300 to 350 dots per inch (dpi). If you try to upload an image that has a lower resolution, we may still accept it, but we cannot accept responsibility if your product does not meet your expectations;
  2. HP Create does not warrant that the products will not contain or include any content that is likely to infringe the IPR of any third party. Subject to clause 16 (Limitation of Liability), HP Create will not be liable to you for damages, costs and losses arising out of any claim made against you for infringement of any IPR of any third party caused by your User Submission or use of the product that includes your User Submission; and
  3. there may be reasonable variations in colour, size and appearance between the product displayed on the HP Create website as it appears on your screen and the product delivered to you and HP Create will not be liable for any such minor variations.

16. Limitation of Liability

If you are a Consumer Customer and we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.


We will always try to ensure that our website is available 24 hours a day. However, we will not be liable if for any reason the website is unavailable at any time, or for any period. To the maximum extent permitted by law, access to our free website, applications, editor and other services are offered without any guarantee or warranty as to their performance. We may make changes to these services from time to time or terminate them at any time and for any reason.


If you use the products for any commercial, business or re-sale purpose:


  • HP Create's liability under these Terms is limited to the amount payable by you to HP Create for the relevant order;
  • HP Create will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity; and
  • you are solely responsible for your acts, omissions, obligations, representations, or misrepresentations in using the products purchased on HP Create for any commercial, business or re-sale purpose. You agree to defend, indemnify and hold us harmless against all claims, lawsuits, liabilities, losses, damages, costs and expenses (including reasonable attorney and expert witness fees), as a result of any claims by your customers, arising out of or in connection with your acts, omissions, obligations, representations, or misrepresentations in connection with your provision or reselling of products purchased on HP Create to your customers or other third parties.

HP Create does not exclude or limit liability for death or personal injury (including to the extent caused by its negligence), for wilful default, for any breach of any undertaking as to title, quiet possession and freedom from encumbrance implied by applicable law, for fraud, fraudulent misrepresentation, for breach of your legal rights in relation to the products or any misrepresentation as to a matter fundamental to its ability to perform contractual obligations or for any other liability that cannot be excluded or limited by law.

17. Protection of Personal Data

Where you have provided us with your personal data, we will use this information: (i) to process your order and supply products and support to you; (ii) as otherwise specified in these Terms; or (iii) in accordance with your consent. We will only collect and use your personal data in compliance with applicable data protection law and the Privacy Statement located at www.hp.com/go/privacy. To exercise your rights of access, rectification, opposition or deletion, please use the ‘Contact HP Privacy Office’ form available from "Personal Data Rights Notice".

18. Other Applicable Terms

When ordering from HP Create, HP Create may communicate with you electronically relating to your order (e.g. by e-mail or text message).


These Terms and sales of products are governed by the laws of the country and locality of delivery.


HP Create products are subject to export laws. After delivery of your purchases, you are responsible for complying with any export requirements if you ship HP Create products outside the United Kingdom (UK).


You may have additional rights under your local statutory or consumer laws, which provide you with other remedies. To the extent that these Terms are inconsistent with the statutory laws of the country where HP Create has delivered the product(s) to you, they are deemed modified to be consistent with such local law.


Important Note: If you, for any reason, do not have access to any of the conditions referenced in these Terms, such as the Privacy Statement we ask you to contact the HP Create and ask for a copy. These Terms and additional conditions referenced herein that are in effect at the time you submit your order will govern such order, so you are encouraged to print and keep a copy of them for your future reference.
